Cornwall Waste Forum v. Secretary of State Eric Pickles

Cornwall Waste Forum St.Dennis Branch has instructed lawyers to serve a s288 claim against Secretary of State Eric Pickles and that copies were served
with SITA, The Environment Agency and Cornwall Council as interested parties.

CWFSDB claim through their Lawyers that the Secretary of State acted
unlawfully in respect of the matter of Appropriate Assessment contained
within the Appeal against refusal of Planning Permission for the St.Dennis Incinerator and as a result the Secretary of State's findings in favour of the Appellant (SITA) should be quashed.

The case will be heard in a few months time in the High Court of Justice in
London and written witness statements will be given, but there will be no
need for witnesses to be present.

Due to what they believe is the strength of the case all the Lawyers concerned have agreed to work on a "no win no fee" basis for the hearing.

As you can see the solicitors feel that we have a case. Although it is no win no fee. We will still need funds, money is coming in, from around our Duchy, and remember we are doing this as much for you as for the people of St. Dennis. I know that not all of you think this incinerator is a bad idea, and you believe what the Environment Agency is telling you. I and others around the UK and EU feel that before very long it will be shown that the EA is not doing a very good job for the good of either the people or the environment, and have no idea of the facts of the disaster incineration actually is.
