huge row: Additional Inquiry Documents

As some of you know there was a huge row on Tuesday at the WDA meeting in Truro. as the Lingard feline refused permission for the public to know what was going on. we were all thrown out of the meeting.
Chris Tofts had steam issuing forth from his ears over it all. I sent in an email to Lavery and co and gave them a through thrashing. I reminded them that we had been sitting in a court case for months and if they had bothered to come along they would realise that we and the inspector had most of what the solicitor was telling untruths about.
This has come in today.
In it is schedule 6 ALL OF IT this is the bit that Lingard has been saying no one must see but her. I have attached the two smaller pieces, if you wish to have schedule 6 please contact Pat Blanchard she will send it on to you. It is 90 pages and is 4Mb which is why I can not send it to you. It is making very interesting reading.

Dear Brenda,

Counsel for the Council at the Inquiry has requested that the following documents be added as Inquiry Documents.

Counsel for the Council considers that it will be necessary to refer to these documents in closing in response to the letter (SITA/1/7) submitted by Mr Scanlon on the last day for the hearing of evidence at the Inquiry (when the Council was in no position to respond to that letter).

The Council’s Inquiry team is concerned that without reference to these documents there is potential for the Inquiry to be misled in that the text within the letter from Mr Scanlon is considered to be inconsistent with the position in a number of the Council’s public documents. The Council has waited until now to submit these documents as there was an attempt to obtain clarification on these points at this week’s Waste Development Advisory Panel and it was considered that if in fact the apparent inconsistencies could be satisfactorily dealt with there would be no need to raise the issue within the Inquiry itself. Unfortunately however, the inconsistencies between Mr Scanlon’s letter and the public documents were not dealt with to the Council’s Inquiry team’s satisfaction.

It is not considered that the Council can bring the apparent inconsistencies between Mr Scanlon’s letter and the public documents without those documents being added to the Inquiry Documents.

Those documents are (attached):-

a) Public minutes of Agenda item No.5 of the WDAP meeting 27 April 2010 (i.e. pages 1-4 only) http://democracy.cornwall.gov.uk/mgConvert2PDF.aspx?ID=2328&T=1

b) Schedule 6 of the IWMC (in particular Part B, but I expect that reference may be needed to the definitions in Part A) which deals with the RPP process (this is omitted from CD/G1 but publicly available at http://www.cornwall.gov.uk/idoc.ashx?docid=3624b223-39fc-4c96-9511-4bc08...) (i.e. electronic pages 1-44); and

c) The public report of Agenda Item no.8 of the WDAP meeting of 14 Sept 2010 (i.e. hard copy pages 48-51, electronic copy pages 50-53) http://democracy.cornwall.gov.uk/mgConvert2PDF.aspx?ID=2328&T=1

d) The Council may wish to add one further (one-two page) document on this same point next week.
